Helpful information for hiring immigrant workers

On Behalf of | Oct 28, 2022 | US Immigration Law

As a Chicago business owner, you know that hiring good employees is vital to the success of your business. The United States is currently made up of a diverse mix of immigrant workers.

In fact, according to the Migration Policy Institute, in 2020, immigrant workers and their children accounted for approximately 26% of the country’s population. When hiring immigrant workers, there are many complex laws and regulations that you must follow.

The right visa is essential

Every immigrant must have an appropriate visa before securing employment in the United States. These can include a green card or various types of work visas.

Before hiring an immigrant employee, verify that they have the right visa for their situation and are authorized to work in the United States. Once you have this authorization, always keep written proof of it.

An authorization typically consists of an I-9 form, along with any other documents the immigrant must provide.

If the immigrant does not have the authorization, you can always try to help them receive it, but the process is long and costly. A better approach may be to refer them to a qualified immigration attorney.

Attracting immigrant employees

When hiring immigrant employees, you need to make sure they are aware that you are hiring. Make your job descriptions detailed, since many immigrant visas only allow for certain types of work.

Take advantage of technology when conducting your interviews. Many employers no longer require in-person interviews, especially after the last few years.

Use technology to your advantage

Your potential employees could be in another location, or even another country. Remote-based interviews can help you find and hire qualified candidates throughout the world, saving you time since they will be ready to work for you upon arriving at your location.

It can be quite a challenge to comply with immigration laws and regulations, especially since they are often changing. Having professional advice and guidance when hiring immigration workers is important and can help you find and retain high-quality employees.
